Privacy Policy

This web site (the "SITE") is operated by BreadStorm LLC ("BREADSTORM"). This Privacy Policy (the "POLICY") describes BreadStorm’s collection, use, and disclosure of information practices in connection with the Site and in connection with the products and services available or enabled via the Site, including but not limited to BreadStorm Cloud services. This Policy applies to the main version of the Site, located at www.breadstorm.com, as well as to any related versions of the Site that BreadStorm operates.

This Policy does not describe BreadStorm's collection, use, and disclosure of information through means other than this Site (e.g., off-line). By using this Site, you acknowledge you have read this Policy and agree you are subject to the BreadStorm Terms of Use. If you have objections to this Policy, you should immediately discontinue use of the Site and the products and services enabled by and offered on the Site.

Collection of Personally Identifiable Information

You are not required to provide any personally identifiable information to visit the Site. BreadStorm automatically collects certain anonymous information regarding use of our Site and services (defined as "USAGE DATA" in the next section, below) and may collect other information in connection with your use of the Site. BreadStorm collects personally identifiable information only when you make it available through your use of the Site. You may be required to provide personally identifiable information to use certain services on this Site and to download or purchase the BreadStorm Software and/or BreadStorm Key(s). In addition, you may submit personally identifiable information through the Site in other ways, including: (a) subscribing to newsletters, editorial content, or promotional content sent via e-mail; (b) using the Site’s feedback forms; and (c) in connection with other products, services, features, or requests made available through the Site. BreadStorm may also provide you with telephone numbers to communicate with BreadStorm. If you dial one of these phone numbers, BreadStorm or a service provider operating on BreadStorm’s behalf may record the date, time, and length of your call and the phone number from which the call originated, along with other information that may be captured. Any Usage Data and/or personally identifiable information resulting from such calls may be used as described in this Policy. The types of personally identifiable information that you provide will depend on the nature of the submission, but could include your name, address, phone number, and e-mail address.

Passive Information Collection

The Site automatically collects certain information and may also customize your visit through technical means, including the following:

  1. Cookies. Cookies are small text files that are placed on your computer’s hard drive by computers (or servers) to identify your computer.

  2. Web Beacons. Web beacons (also known as pixel tags, Internet tags, clear GIFs, or single-pixel GIFs) are electronic images embedded into a webpage.

  3. IP Address Logs. BreadStorm also logs Internet Protocol (IP) addresses -- the location of your computer on the Internet.

Cookies allow BreadStorm to recognize you when you visit the Site, to personalize your experience, and generally to serve you better. For example, if you enter your name or e-mail address on one of the Site’s forms, it may be stored in a cookie so you do not have to enter it again on other forms on the Site. Cookies, web beacons, and IP addresses are also used to compile data regarding Site usage (what web site you came from, what pages of the Site you visit, how long you were on the Site, what type of browser you are using, what web site you went to, etc.). You can disable cookies or otherwise manage them through tools provided with your browser software and with third-party software packages. Anonymous information regarding use of our Site and services that is collected and/or aggregated by or on behalf of BreadStorm through the use of such technical means or otherwise is referred to in this Policy as "USAGE DATA."

Information Use

  1. Personally Identifiable Information. Personally identifiable information collected by BreadStorm through your use of the Site may be stored on servers or in a cookie on your computer and may be used by BreadStorm for any of the following purposes:

    • To confirm or fulfill a request that you make.
    • To support the use of BreadStorm Keys. Some features of BreadStorm’s software products require unlocking through use of a BreadStorm Key. When you use a BreadStorm Key to unlock those features, you may provide personal information that BreadStorm maintains to enable us to troubleshoot and support your use of the Software features related to that BreadStorm Key.
    • To follow up on any request that you have previously made.
    • To communicate with you regarding BreadStorm’s products and services or updates thereto.
    • To send promotional materials, newsletters, or other content via e-mail or otherwise, but only if you have indicated that you wish to receive such materials. If you no longer wish to receive a particular e-mail or newsletter from BreadStorm, you must follow the opt-out instructions included in such e-mail or newsletter.
    • To improve your user experience.
    • To manage BreadStorm’s business and its relationships with customers and other third parties to which BreadStorm may disclose personally identifiable information pursuant to this Policy.
    • For Site administration, analysis, research, development, optimization, and other internal purposes, including, without limitation, to compile Usage Data.
  2. Usage Data. Usage Data is used by BreadStorm for administrative, analytical, research, optimization, and other purposes. For example, BreadStorm may use statistical analyses of Usage Data in order to measure interest in the various areas of the Site and for development purposes. IP Addresses are also used for systems administration and troubleshooting purposes.

With respect to promotional materials and newsletters that BreadStorm may send from time to time, BreadStorm will not continue to send you such communications if you ask us not to. However, you agree that BreadStorm may send to you and you cannot opt out of, communications of a transactional or relationship nature, including, but not limited to, communications regarding fraudulent or illegal activity, the status of your account, changes to this Policy or the BreadStorm Terms of Use, as well as communications to confirm, fulfill, and follow up on your account registration or a request submitted through the Site.

Information Sharing

BreadStorm may share personally identifiable information that you provide with third parties in the following cases:

  1. Requests. If you request information or services through the Site, you agree that BreadStorm may share personally identifiable information with third parties as may be necessary to provide such information to or perform such services for you. Personally identifiable information also may be included in reports to these third parties, but only when you have intended to submit the information to the third party as described above. After the information is provided to such third parties, BreadStorm does not control their subsequent use or disclosure of information.

  2. Service Providers. BreadStorm may work with third parties that provide services on its behalf, including, among others, providers of analytical, development, promotional, research, library, credit card processing, technical, and other services. For example, if you make a payment to BreadStorm by credit card, BreadStorm may share your personally identifiable information and credit card information with a third party to process credit card transactions or such information may be collected directly by the credit card processing service provider on BreadStorm’s behalf. In such cases, BreadStorm asks that the third party maintain your personally identifiable information as confidential and use the information only to perform the services specified by BreadStorm.

  3. Other. BreadStorm expressly reserves the right to release any personally identifiable information or other information you provide to third parties under the following circumstances: (a) when required by law or legal process; (b) to investigate and/or take action against illegal activity, suspected abuse, or unauthorized use of the Site; (c) to protect the property or safety of our users or others; (d) to enforce our Terms of Use; and (e) in connection with any sale or other transfer of ownership of all or a part of BreadStorm. Further, if you make any personally identifiable information publicly available on the Site, BreadStorm reserves the right to disclose such information to third parties.

Please note that the messages that BreadStorm sends to you to confirm, fulfill, or follow up on a request may incidentally include promotional material or other content from BreadStorm.

BreadStorm reserves the right to share Usage Data with any third party for any reason.

Changes to this Policy

Any changes to this Policy will be posted on the Site in this location and this Policy will be identified as "Updated." Your continued use of the Site after such notice constitutes acceptance of such changes. In the event of such changes, you can then choose to do nothing, or to modify the personally identifiable information you have submitted through the Site by contacting us. (Please see the last section of this Policy for BreadStorm’s contact information.)

Security

We take steps to keep your personally identifiable information physically secure in our data centers, and it is accessible only to authorized personnel as needed to perform operations governed by this policy. Please keep in mind that despite these measures, BreadStorm cannot guarantee or warrant 100% security of its servers and databases. Moreover, personally identifiable information that you submit through the Site may be intercepted or otherwise disclosed despite the security measures that BreadStorm uses.

Message Boards

BreadStorm also may offer message boards, bulletin boards, chat rooms, comments areas, or other forums ("Forums") on the Site, including but not limited to Cloud sharing of BreadStorm Bun Files, for use by visitors who are 18 years of age or older. Any information you disclose when posting a message in these Forums may become public. You should not include any information in your posting that you do not want other parties to see or use. Moreover, if you post any messages in the Forums that include your e-mail address or phone number you may receive unsolicited e-mail or calls from third parties.

Children

BreadStorm believes that it is especially important to protect children’s privacy online. BreadStorm does not knowingly collect or use any personally identifiable information from children under the age of 13, and BreadStorm does not knowingly provide any personally identifiable information, regardless of its source, to any third party for any purpose whatsoever from visitors younger than 13 years old. No information should be submitted to BreadStorm by visitors younger than 13 years old.

Collection of Information by Third Parties

As noted above, third parties may collect information about you and your use of the Site through the use of cookies, web beacons, and other similar technologies. For example, we may work with companies that collect statistical information regarding Site usage and provide related analytical services.

Third-Party Sites

Please be aware that advertisers or web sites with links to and from this Site may collect personal information about you through the use of cookies, web beacons, and other similar technologies. And remember, this Policy does not apply to, and cannot control the activities of, those other advertisers or web sites. BreadStorm is not responsible for the privacy practices employed by any third-party web site. These other web sites may independently collect data or solicit personally identifying information and may or may not have their own published privacy policies. BreadStorm recommends that when you link to other web sites, including but not limited to Facebook® and Twitter®, to read the privacy statements of all such third-party sites before submitting any personally identifying information to those sites.

Correcting or Removing Your Information

The information you provide helps us to develop better products and services and we take seriously the obligation to maintain it accurately. If you have submitted personally identifiable information through the Site, or if someone else has submitted your personally identifiable information through the Site, and you would like to have that information deleted from our databases, please contact us at privacy@breadstorm.com or P.O. You may also contact us through either of the above methods if you would like to see the personally identifiable information BreadStorm has collected about you through the Site.
